Bank of America agreed to pay $1 million to settle a class action lawsuit that accused the financial corporation of violating federal law by sending text messages and robocalls to cell phones without prior express consent.
Plaintiff Richard Swift alleged that he received more than 20 calls from Bank of America to his cell phone regarding another customer’s debt. Swift claimed this was a violation of the Telephone Consumer Protection Act because he never provided his phone number nor consented to be contacted by BofA on his cell phone.
According to the TCPA class action lawsuit, Swift answered several of the phone calls and asked the company to stop contacting him, but the phone calls didn’t cease.
If the settlement is granted final approval by the court, Class Members will receive between $15 and $25 without doing anything.
Individuals who wish to object to the terms of the settlement must do by May 30, 2016.
Who’s Eligible
Bank of America TCPA class action settlement Class Members include all individuals who were contacted by the company through an automatic dialer or were sent a text message on their cell phones regarding a Bank of America account other than their own without prior express consent between Feb. 1, 2013 and Apr. 21, 2016.

Potential Award
$15 – $25
Each Class Member will receive an equal portion of the $1 million Settlement Fund, after court fees are paid. The actual amount will be a minimum of $15 but no more than $25.

Class Members don’t need to file a Claim Form to receive a portion of the Settlement Fund. Bank of America settlement Class Members will automatically receive between $15 to $25 without doing anything.

Spoke to Huntington Bank who claims they have no idea, then was told to talk to the claim administrators who a Jennfier has no idea, claims it was paid, How can it be paid if it bounced? So I called Morgan and Morgan the lawyers who at this time is looking into it.
