Super Mex FACTA settlement

A settlement has been proposed in a class action lawsuit alleging Super Mex Restaurants Inc. violated the Fair and Accurate Credit Transactions Act (FACTA) by printing customers’ credit card or debit card expiration dates on printed receipts.

If you used a personal debit or credit card at the Super Mex restaurant located at 5254 Faculty Avenue in Lakewood, Calif. between May 2, 2012 and April 7, 2014, and you were provided with an electronically printed receipt at the point of sale that included the payment card’s expiration date, you may be entitled to benefits from this FACTA class action settlement.

FACTA is a federal law that was implemented to reduce Americans’ risk of identity theft. It establishes a variety of protections for consumers, including the establishment of limitations on the printing of credit and debit card numbers and expiration dates on receipts. Under FACTA, merchants are prohibited from printing more than five digits of a customer’s card number or expiration date on a receipt provided at the point of sale. Violations of this provision may result in statutory damages ranging from $100 to $1,000 per violation.

Super Mex disputes the allegations and denies that it willfully violated FACTA. However, the restaurant agreed to settle the Super Mex class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

Who’s Eligible

Class Members of the Super Mex settlement include anyone who used a personal credit or debit card at the Super Mex restaurant located at 5254 Faculty Avenue in Lakewood, Calif., and who was provided with an electronically printed receipt at the point of sale or transaction and the receipt included the expiration date of the payment card.

Potential Award

$50 Super Mex Gift Card.

Proof of Purchase

Class Members must submit either a copy of the customer receipt or a copy of the credit or debit card statement that shows you made a transaction at the Lakewood Super Mex location during the Class Period.

      The court granted the settlement approval on 8/29/16. There is a 30 day period in which appeals can be filed. Claims will not be paid until after the 30 day period expires. The settlement website has a toll free number that claimants can call to contact class counsel with any questions. Keep checking Top Class Actions for updates. We will let our viewers know as soon as we learn checks are in the mail!
