A settlement has been reached in a class action lawsuit that alleges The Cheesecake Factory Inc. failed to reimburse business expenses, made unlawful deductions, received improper rebates, maintained an unlawful dress code policy and/or engaged in unfair business practices under California labor laws.
If you were employed as a non-exempt employee of The Cheesecake Factory in California at any time from May 10, 2006 and Jan. 29, 2016, you may be entitled to a cash payment from the class action settlement.
The Cheesecake Factory class action lawsuit was initially filed in May 2010 by plaintiffs Christopher Reed, Adrienne Reed and Brian Watts. This case was coordinated with a related case titled Sikora v. The Cheesecake Factory Inc. The consolidated litigation has been titled The Cheesecake Factory Labor Code Cases.
The Cheesecake Factory defendants deny the allegations but agreed to settle the class action lawsuit to avoid the expense and uncertainty of trial.
Under the terms of the proposed class action settlement, The Cheesecake Factory will pay up to $1.85 million to resolve the litigation. The class action settlement was preliminarily approved on Jan. 29, 2016.
Class Members who wish to object to or opt out of The Cheesecake Factory class action settlement must do so no later than April 29, 2016.
Who’s Eligible
Class Members include all non-exempt employees of The Cheesecake Factory Inc. or The Cheesecake Factory Restaurants Inc. who were employed as a server, food runner, front desk, baker, cashier, bartender and/or busser in California at any time from May 10, 2006 through Jan. 29, 2016.
NOTE: If your claims were previously released by the case titled Guardado, et al. v. The Cheesecake Factory Restaurants Inc., et al. and you have not been employed by The Cheesecake Factory since Oct. 5, 2011, you are not eligible for benefits from this class action settlement.
Potential Award
Varies. Settlement payments will be calculated based on the number of individual pay periods each Class Member worked during the Class Period.
