Movie Tavern Theater employees who worked at one of the in-theater dining facilities within the state of Pennsylvania are expected to benefit from a $750,000 class action settlement.

According to the Settlement Website, Movie Tavern workers in the positions of bartender, server or food runner who were paid with “tips” instead of the minimum wage will receive the pay difference, if they decide to file a Claim in this wage and hour class action settlement. 

Plaintiff Tianna Kotchmar filed the Movie Tavern class action lawsuit over allegations of Fair Labor Standards Act violations as well as infractions of the Pennsylvania Minimum Wage Act.

The Court has approved of the preliminary settlement but those Class Members who wish to opt-out must file an objection by May 31, 2016.

Who’s Eligible

Class Members include the approximate 1,000 “tipped” employees at Movie Tavern locations in Pennsylvania between July 23, 2012 and Dec. 31, 2015.

Potential Award

Varies.

The $750,000 Settlement Fund will be divided with all eligible Class Members after Court expenses are paid. The exact amount each Movie Tavern employee gets will depend on the cash wage they received in relation to the minimum wage.

For example: If a Movie Tavern employee was paid an hourly wage of $2.83, yet the minimum wage is $7.25, then that worker is expected to receive $4.42 for each hour worked.
