A settlement has been proposed in a class action lawsuit that alleges DP Security LLC, DP Security Services Inc. and Michael Davenport Sr. (collectively, “DP Security”) violated labor laws that are designed to protect workers’ rights.
According to the wage and hour class action lawsuit, DP Security failed to provide workers with timely meal periods and rest periods, failed to provide accurate wage statements, failed to timely pay workers for all wages due upon separation, and other related claims.
DP Security denies the allegations but agreed to settle the wage and hour class action lawsuit to avoid the risk and uncertainty associated with continued litigation.
Under the terms of the proposed class action settlement, DP Security will pay $1.3 million to resolve the litigation. However, if any of the defendants become subject to a bankruptcy proceeding while they are liable under this settlement agreement, the settlement amount will increase to $5.75 million, minus any payments that are made prior to the bankruptcy.
Class Members who wish to object to the DP Security class action settlement must do so no later than May 6, 2016.
Who’s Eligible
Class Members of this wage and hour settlement include all security guards employed by DP Security between April 11, 2010 and Dec. 31, 2015. Approximately 387 Class Members are eligible for benefits from this settlement.

According to the settlement notice, the individual payments will be “based proportionally on the actual number of qualifying shifts each Class Member worked during the claims period as recorded by DP Security.”
