Strategic Screening Background Check Class Action Settlement

Strategic Screening Solutions and Liberty Screening Solutions have agreed to settle a class action lawsuit that claims the background check companies violated federal law when preparing consumer reports for the purpose of employment.

Plaintiff James Ryals Jr. filed the class action lawsuit over allegations that Strategic Screening violated the Fair Credit Reporting Act by “reporting criminal records to employers or potential employers without either furnishing notice to the consumer of the fact of such reporting or confirming the completeness and timeliness of the records at the time it prepared the report or (2) reporting inaccurate criminal record information.”

Both Strategic Screening and Liberty Screening have denied all claims in this FCRA lawsuit but agreed to settle in order to avoid the burden, risk, and cost of further litigation.

Those Class Members who want to opt-out of the settlement must do so no later than May 23, 2016.

Who’s Eligible

Class Members of the 1681k settlement include all U.S. residents who were the subject of a background check, supplied by Strategic Screening between Nov. 26, 2012 and June 1, 2015 for the purposes of employment.

This consumer report contained at least one adverse public record of arrest, indictment or conviction that was obtained by a source other than a government entity. Class Members must not have received any part of that report or a written notice that they were the subject of the report on the day the report was furnished.

U.S. residents who are also a member of the 1681c subclass may be entitled to additional funds if the consumer report was furnished for a position that had an annual salary of less than $75k and the defendants reported criminal history information that pre-dates the report by more than seven years.

$41

Class Members who received a 1681k notice will automatically receive a check for $41. Those individuals who received a 1681c notice and want to receive more than $41, will need to submit a Claim Form before the deadline.
