A settlement has been reached in a class action lawsuit alleging tenants of Royal Pines Apartments and Townhomes were unlawfully charged increased rental rates. If you lived in an apartment or townhome at the Royal Pines Apartments and Townhomes in Fremont, Calif., you may be entitled to payment from the unlawful rent increase class action settlement.

The Royal Pines Apartments class action lawsuit was filed by a group of tenants who claim the defendants wrongfully increased their rents in violation of Fremont’s Residential Rent Increase Dispute Resolution Ordinance and other California laws.

The defendants deny any wrongdoing but agreed to settle the unlawful rent increase class action lawsuit to avoid the cost and uncertainty of a trial. The defendants have agreed to pay $500,000 to resolve the Royal Pines Apartments class action lawsuit.

Class Members who wish to exclude themselves from the Royal Pines Apartments class action settlement must do so no later than June 4, 2016.

Who’s Eligible

Class Members of the unlawful rent increase settlement include all persons or tenants who, between Jan. 9, 2010 and April 4, 2016, lived in an apartment or townhome at the Royal Pines Apartments and Townhomes at 1440 Mowry Avenue in Fremont, Calif., and received at least one notice of change of terms of tenancy that did not include the following language:

“You are encouraged to contact the Property Manager … to discuss this rent increase for your rent unit. However Chapter 19 of Title II of the Fremont Municipal Code provides a procedure for conciliation, mediation and fact finding for disputes over rent increases. To use the procedure and secure additional information about the city ordinance, you must contact Mediation Services at (510) 733-7945 within fifteen days following receipt of this notice.”

The amount each Class Member receives will depend on a number of factors, including the length of time they paid increased rent since Jan. 9, 2010, the amount of monthly increased rent paid, whether a co-tenant also paid increased rent and the total number of Class Members who participate in the settlement.

According to the settlement website, if all eligible Class Members participate in the settlement, the average benefit payment will be $1,801.56. However, the actual amount received may be substantially more or less, depending on the above factors.
