A $3.6 million class action settlement was reached with Pacific Bell Directory and Western Directory, which is now YP Advertising & Publishing, to resolve allegations that YP violated wage and hour laws by not providing proper breaks and overtime pay to its employees. If you worked for YP, you may qualify to benefit from this class action settlement.
The wage and hour class action lawsuit filed by plaintiff Justin Lefevre alleged that YP violated California labor laws by not providing meal and rest breaks, paid overtime, and itemized wage statements. In addition, Lefevre claimed that YP also violated the federal Fair Labor Standards Act (FLSA) by failing to pay overtime to a group of employees who worked outside of California.
There are two groups of Class Members — the California Class and the FLSA Class:
- The California Class includes all current and former telephone sales representatives who worked at call centers in the following California cities: Corona, Pleasanton and Riverside from June 16, 2010 through Dec. 18, 2015
- The FLSA Class includes all current and former telephone sales representatives who worked for YP during the same dates at call centers in the following cities: Birmingham, AL; New Haven, CT; Jacksonville, FL; Rosewll, GA; Tucker, GA; Southfield, MI; Maryland Heights, MO; Olivette, MO (cyber representatives only); St. Louis, MO (cyber representatives only); Charlotte, NC; and Henderson, NV.
YP does not admit to any wrong doing, but the company has agreed to the terms of this wage and hour class action settlement to avoid the distraction, costs, and risks of continuing this litigation. This Pacific Bell class action settlement was granted preliminary approval on Dec. 16, 2015 by U.S. District Judge William H. Orrick.
Who’s Eligible
The Pacific Bell settlement is open to the following Class Members:
- The California Class includes all current and former telephone sales representatives who worked at call centers in the following California cities: Corona, Pleasanton and Riverside from June 16, 2010 through Dec. 18, 2015
- The FLSA Class includes all current and former telephone sales representatives who worked for YP during the same dates at call centers in the following cities: Birmingham, AL; New Haven, CT; Jacksonville, FL; Rosewll, GA; Tucker, GA; Southfield, MI; Maryland Heights, MO; Olivette, MO (cyber representatives only); St. Louis, MO (cyber representatives only); Charlotte, NC; and Henderson, NV.
