Allstate Insurance

A settlement has been reached in a class action lawsuit alleging certain Allstate policyholders were denied reimbursement or waiver of their collision deductibles following a car accident with an uninsured motorist.

The proposed Allstate settlement will resolve a class action lawsuit that alleges that some Allstate policyholders with automobile policies issued between Nov. 27, 2009 and Dec. 29, 2015 were denied the benefit of a waiver of their collision deductible when they submitted a collision claim to Allstate involving an accident with an uninsured motorist, pursuant to Allstate’s California Amendatory Endorsement AU2250-6 or AU2250-7.

Plaintiff Mona K. Webb filed the Allstate class action lawsuit in November 2013 after she was rear-ended by an uninsured vehicle. According to the class action lawsuit, Allstate confirmed that the vehicle that struck her was uninsured.

“Contrary to its policy of insurance, Allstate did not pay the full amount of the loss and Ms. Webb was required to pay the deductible amount to have her car repaired,” the Allstate class action lawsuit alleges. “Allstate did not waive the deductible and it did not reimburse Ms. Webb for the deductible.”

Webb alleges that Allstate’s refusal to waive or reimburse her deductible was a breach of Allstate’s statutory and contractual obligation to pay her the full amount of her collision loss.

Allstate denies the allegations and maintains its actions and policies are in compliance with the applicable laws and regulations. However, the company has agreed to settle the class action lawsuit to avoid the expense, inconvenience and burden associated with ongoing litigation.

Who’s Eligible

Class Members of the Allstate settlement include: “all persons insured under an automobile policy issued by Allstate at any time during the period from November 27, 2009 through December 29, 2015, which provided for a waiver of the collision deductible in the event of an accident with an uninsured motorist pursuant to California Amendatory Endorsement AU2250-6 or AU2250-7, and who had such an accident with an uninsured motorist, but did not receive a waiver of the collision deductible, payment or reimbursement of the collision deductible pursuant to the terms of the policy.”

Potential Award

Varies.

Under the terms of the class action settlement, Allstate has agreed to pay Class Members who submit timely and valid claims 100 percent of the unpaid collision deductible plus $35 in lieu of interest.

Claimants must provide their Allstate policy number, claim number and date of loss.

    Hell, it should go back further. I was caused a collision by an uninsured, undocumented immigrant, with no USA state issued DL and I had to pay my full deductible AND pay for a rental while my car was being repaired AND I have just bough the vehicle 5 days prior. it was BS! I took the driver to small claims and won but they paid, hell, never even showed up to court.
