$3.95M Viva Aerobus class action settlement

A $3.95 million Viva Aerobus settlement resolves claims the airline recorded customer service calls without consent.

The Viva Aerobus settlement is open to California residents who made or received recorded calls to or from Viva Aerobus’s customer service department between Aug. 7, 2022, and Nov. 10, 2023.

According to plaintiffs in a class action lawsuit, Viva Aerobus violated California laws by recording telephone calls without consent. The airline allegedly failed to inform callers to its customer service line that their calls would be recorded.

Viva Aerobus is a major Mexican airline that offers low-cost flights to and from Mexico.

Viva Aerobus hasn’t admitted any wrongdoing but agreed to pay $3.95 million to resolve the recorded calls class action lawsuit.

Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Settlement payments are estimated to be $21.45 per call but could be as high as $100 per qualified call. Actual payment amounts will vary depending on the number of participating class members and other factors.

The deadline for exclusion and objection is Nov. 9, 2024.

The final approval hearing for the settlement is scheduled for Dec. 18, 2024.
