Virginia Mason Medical Center agreed to a $3.5 million class action lawsuit settlement to resolve claims it shared patient portal data with third parties, such as Google and Facebook.

The settlement benefits Washington residents who are or were patients of Virginia Mason Medical Center, Virginia Mason Health System or their affiliates between Oct. 10, 2015, and May 18, 2023, and who exchanged communications at virginiamason.org or the MyVirginiaMason patient portal.

Virginia Mason Medical Center is a Seattle-based hospital that offers a range of services, including primary care, cancer treatment, surgery and more.

According to a class action lawsuit, Virginia Mason Medical Center shared data from its patient portal and website with third parties, such as Facebook and Google, without patient consent. The data breach violates Washington’s state privacy laws.

The hospital has not admitted any wrongdoing but agreed to pay $3.5 million to resolve the allegations. If the settlement is not enough to cover all claims, Virginia Mason has agreed to pay up to an additional $3.25 million.

Under the terms of the Virginia Mason Medical Center settlement, class members can receive a cash payment based on their portal usage.

Class members who logged into the MyVirginiaMason patient portal can receive $90, while those who used the public website can receive $45.

Payments may be adjusted on a pro-rata basis depending on the number of claims filed with the settlement.

The settlement also includes non-monetary benefits. Virginia Mason agreed to create a Web Governance Committee to assess the implementation and use of analytics and advertising technologies on its web properties. For two years after the settlement’s final approval, Virginia Mason will not use certain tracking technologies unless the committee makes the requisite determination under federal law.

The deadline for exclusion and objection is March 28, 2025.

The final approval hearing for the Virginia Mason Medical Center patient portal class action lawsuit settlement is scheduled for May 23, 2025.

To receive settlement benefits, class members must submit a valid claim form by April 28, 2025.

Who’s Eligible

Washington residents who are or were patients of Virginia Mason Medical Center, Virginia Mason Health System or their affiliates between Oct. 10, 2015, and May 18, 2023, and who logged into the MyVirginiaMason patient portal or used Virginia Mason’s public website, www.virginiamason.org, to view or search for medical-related information.

Potential Award

Up to $90 for users of the MyVirginiaMason patient portal and up to $45 for patients who used Virginia Mason’s public website.
