Ashley Furniture Industries Inc. has agreed to settle a class action lawsuit stemming over allegations that the retail store asked customers for personal identification information (PII) when using a credit card, in violation of California state law.

Plaintiff Perry Johnson filed the Ashley Furniture HomeStore class action lawsuit after purchasing an item with his credit card. According to Johnson, he was taking the item with him so there was no need to request and record any personal identification information.

The Ashley Furniture class action lawsuit claims that requesting and recording credit card information violates the Song-Beverly Credit Card Act which states that no person, firm, partnership, association or corporation should request or require, as a condition to accept a credit card payment, to be provided with personal identification information which is recorded upon the transaction.

Class Members who file a Claim Form will receive a $25 voucher that can be used to purchase products at an Ashley Furniture HomeStore in California.

Ashley Furniture Industries denies any wrongdoing but agreed to the terms of the class action settlement in order to avoid the cost of further litigation.

Who’s Eligible

Class Members include Ashley Furniture HomeStore California customers who were required to provide their “Personal Identification Information” which was recorded in connection with a credit card transaction between Oct. 10, 2012 and Dec. 2, 2015 in which you took all of your purchases with you at the conclusion of the transaction.

There are 15,000 Known Class Members and about 10,000 Unknown Class Members.

Potential Award

$25 Merchandise Voucher.

Ashley Furniture Class Action Lawsuit Settlement Class Members will receive one $25 voucher for merchandise as a form of in-store credit. The settlement voucher is not considered a gift card or gift certificate under California law, which means customers cannot ask for cash back when the balance drops below $10.

N/A.

In order to receive an Ashley Furniture voucher, Unknown Class Members must submit a Claim Form before the Feb. 22, 2016 deadline.

NOTE: If you received a notice about the Ashley Furniture class action settlement and it did not include a Claim Form, then you don’t need to take any further action to receive a benefit.

If you received a Claim Form with the settlement notice, you are an “Unknown Class Member” and you must submit a Claim Form in order to receive benefits.
