Casey’s Marketing Company and Casey’s Retail Company have agreed to settle a class action lawsuit that accuses them of violating the Fair Credit Reporting Act with regard to their employment background checks. If you applied for a job or were employed by Casey’s, you may be entitled to a cash payment from the class action settlement.

The proposed FCRA settlement will resolve allegations the Casey’s defendants violated the Fair Credit Reporting Act by obtaining background checks on employees and job applicants without providing a “stand alone” disclosure informing them that a background check would be procured for employment purposes.

Plaintiff Jacqueline Johnson initially filed the FCRA class action lawsuit after she applied to work at a Casey’s General Store, which was operated by Casey’s Marketing. She alleges the authorization form that she signed to allow Casey’s to procure a background check was far broader than allowed under FCRA. Johnson asserts that the form she signed “includes a vast and limitless release of information that applies to third parties’ provision of information,” in violation of the FCRA.

Casey’s denies the allegations but agreed to settle the background check class action lawsuit to avoid the expense and uncertainty of ongoing litigation. Under the terms of the FCRA class action settlement, Casey’s will pay $500,000 into a settlement fund.

If you want to opt out of or object to the Casey’s FCRA class action settlement, you must do so no later than Feb. 9, 2016.

Who’s Eligible

You are a Class Member of the Casey’s FCRA settlement if Casey’s procured a background check on you at any time from Feb. 24, 2013 to July 15, 2015 without providing you with a “stand alone” disclosure informing you that a background check would be procured for employment purposes.

Eligible Class Members should have received notice of the Casey’s FCRA class action settlement in the mail. If you did not receive notice of the FCRA settlement but believe you are a Class Member, contact the Settlement Administrator at 1-877-235-4599.

Potential Award

Approximately $30 per background check.

Proof of Purchase

N/A. Membership in the Class will be determined based on Casey’s records. If you received notice of the FCRA class action settlement, you do not need to take any action in order to receive payment. A check will be mailed to you after the settlement becomes final.
