A class action lawsuit filed by plaintiff on behalf of herself and others who purchased Earth Exer-Walk shoes alleging the shoe company was in violation of law by labeling their shoes with health benefits has recently reached a settlement.

Earth’s labeling on the Exer-Walk shoes indicated that the shoes had the ability to “improve posture,” “reduce joint stress, “strengthen core muscles” and maximize calorie burn” in consumers who wear the shoes, according to the class action lawsuit.

Earth has denied any wrongdoing in association with the claims brought forth against the company. The lead plaintiff in the class action lawsuit and Earth reached an agreement to settle the claims in an effort to avoid the cost and risks of allowing the case to continue to go on to trial.

Class Members who would like to request to be excluded from the Exer-Walk class action lawsuit settlement must do so in writing by sending the written request to the Settlement Administrator and must include the following: Name, address, signature, name and number of the case and a statement saying he/she wishes to be excluded from the settlement class. Requests for exclusion must be postmarked by May 19, 2016.

UPDATE: The claim form deadline and exclusion deadline have been extended to 05/19/16. The final hearing is now scheduled for 06/20/16.

Who’s Eligible

Consumers who purchased an Earth Exer-Walk shoe between Jan. 1, 2009 and Oct. 4, 2015 are eligible to be included in the class action settlement.

Potential Award

Varies.

Class Members who submit a valid Claim Form will receive a pro rata distribution of the Settlement Fund of $270,000 after the following expenses have been deducted from the fund: notice and administration costs ($80,000), attorney’s fees and costs ($90,000) and an incentive award to the lead plaintiff ($2,000).

Proof of Purchase

No proof of purchase is required. You must certify via your signature that you purchased Earth Exer-Walk shoes between Jan. 1, 2009 and Oct. 14, 2015.

    I’m a 73 year old female and I have been trying to find a pair or Earth Exerwalk shoes in size 8 online for months because the pair I own are getting old and worn looking. It’s so very unfortunate that someone sued Earth over this shoe. It’s the only shoe that ever “healed” my feet when my arches were hurting and my heels were broken down from walking too much in sandals. I swear by the support and foot comfort these shoes afford.
    I wish Earth would make another “tennis shoe” with recessed heels. The only recessed heel shoes they have now are not attractive to me and don’t look like they would offer the same level of support that the Exerwalk does.

    JENNELL, at Top Class Actions facebook page. Under visitor post you can post checks of various class actions. I actually saw a picture of one.

    I never received a check. I sent an email to KCC no reply yet.

    Never received.. I was told about two days ago that checks are just starting to go out.. I don’t believe anyone has received anything yet..someone please post a picture of the check.. Somebody really has said this to make people believe that…why lie and post…
