USAA

A settlement has been reached in a class action lawsuit alleging United Services Automobile Association, USAA Casualty Insurance Company, USAA General Indemnity Company, and Garrison Property and Casualty Insurance Company (collectively, “USAA”) have improperly applied depreciation when adjusting claims for structural losses under homeowners insurance policies in Arkansas.

USAA denies any wrongdoing but agreed to settle the class action lawsuit to avoid the expense and uncertainty associated with ongoing litigation.

This settlement will resolve allegations that the USAA defendants or persons acting on their behalf improperly applied depreciation when making actual cash value payments when adjusting claims for structural losses under homeowners insurance policies, by improperly applying depreciation to labor and other non-material items.

Who’s Eligible

Class Members of the USAA settlement include anyone who was insured under a USAA homeowners insurance policy that provided coverage for any structure located in Arkansas that:

  • Suffered a structural loss between Jan. 1, 2006 and Dec. 31, 2014 that was determined to be covered by the USAA homeowners insurance policy;
  • Received from USAA an actual cash value payment for the structural loss; and
  • The actual cash value payment was made based on an estimate USAA (or someone acting on its behalf) prepared that applied depreciation.

    USAA is attempting to avoid paying reasonable restoration costs to my home for damages caused by the replacement of waste lines within and under the home. They have offerred 25% of reasonable costs without any explanation of how they calculated the amount. They did nor reply to my offer to provide estimates The casualty occurred just a little over 6 months ago. They paid 4 months relocation costs to an AIRbnb, but we are now back in the home without a kitchen sink without a laundry, with one bath in need of repair and another down to the studs, with damaged asbestos ceilings and with damaged flooring. The adjustor is now leaving messages that he works 8-4 M-F and has not spoken about further relocation funds. We shopped Goodwill for furnishings since our belongings were moved to storage at USAA expanse. USAA has paid for the storage to date, but we have not corresponded about the costs of the packback. They have hired a contract adjustor who believres his job is to screw us.( and is not nice about it). We could not finish this job until well into the second quarter of 2022 even if we had all funds in hand now rather than none. Anyone else have a story like this to talk about?

    This just happened with us with Farmers insurance.

    This same depreciation situation is ocuring with my loss in Ga. USAA is the insurer. The loss was 5/21/15. Any suggestions?
