Comcast has reached an agreement to pay $3.7 million in a class action settlement to resolve claims that the cable company did not pay Customer Account Executives (CAEs) for all work time between Dec. 29, 2007 and Oct. 2, 2015.

The Comcast class action lawsuit brought forth allegations of violations of the Pennsylvania Minimum Wage Act, the Pennsylvania Wage Payment and Collection Law and unjust enrichment.

Comcast has denied any wrongdoing in reference to claims brought against the company and has asserted they did in fact correctly pay CAEs for all work time, including overtime pay.

In this situation, the court did not make a determination as to which side was right in the lawsuit. Both sides agreed to the terms of the settlement to resolve claims in the lawsuit.

If you wish to be excluded from the Comcast CAE class action settlement, you must submit your request for exclusion to the claims administrator by Jan. 29, 2016.

Who’s Eligible

Class Members of the Comcast CAE class action settlement include:

All current and former employees of Comcast who worked as a Customer Account Executive (or a similar position) in Pennsylvania at least one day from Dec. 29, 2007 through Oct. 2, 2015.

Potential Award

Varies.

The amount of the settlement payout for eligible Class Members varies and is calculated using a formula that takes into consideration work weeks employed during Dec. 29, 2007 and Oct. 2, 2015. Pre-Prep-Time work weeks (between Dec. 29, 2007 and June 25, 2011) will be weighted 5 times more than post-Prep-time work weeks (work weeks beginning on or after June 26, 2011.)

For those who decide to be a claimant, an estimated payment amount is shown on your Claim Form. However, the actual settlement may actually be more than the amount shown, as the final payment is based on the total number of claimants.
