The restaurant chain Pollo Operations Inc. has agreed to pay $2.15 million in order to settle a class action lawsuit that claimed the company violated the Telephone Consumer Protection Act (TCPA) by sending out unsolicited faxes with advertisements for the restaurant Pollo Tropical.
Plaintiff Daisy Inc. filed the TCPA class action lawsuit against Pollo Tropical claiming that between December 2010 and January 2011 the restaurant company sent out an estimated 6,096 coupons through facsimile advertisements.
The Pollo TCPA class action lawsuit settlement will award Class Members who submit a valid Claim Form up to $500, depending on how many claims are filed.
Pollo Tropical has not admitted any fault or liability in the TCPA class action lawsuit but has agreed to pay the $2.15 million settlement in order to avoid the cost of further litigation.
UPDATE: On Mar. 29, 2016, the Court granted final approval of the Pollo Tropical TCPA class action settlement.
UPDATE 2: Top Class Actions has confirmed with the Pollo Tropical Settlement Administrator that checks were disbursed to Class Members on May 13, 2016. Keep checking this article for more updates as they become available.
Who’s Eligible
The TCPA class action settlement is open to all Class Members who were sent a facsimile image of a Pollo Tropical coupon between Dec. 23, 2010 and Jan. 5, 2011 by or on behalf of Pollo Operations Inc.
This should include more than 6,000 potential Class Members.
Potential Award
Up to $500.
Pollo TCPA Class Members will receive a portion of the $2.15 million settlement not exceeding $500 per claim.
Proof of Purchase
In order to receive financial compensation for the TCPA class action lawsuit settlement, Class Members must fill out a valid claim form no later than Feb. 8, 2016. Class Members must also verify ownership of the fax number that received the unwanted Pollo advertisement.
