Kwong Yet Lung Co. Inc. doing business as International Marketplace has agreed to settle a class action lawsuit alleging it printed customer receipts that included more than the last five digits of credit and debit card numbers and/or the expiration date of the payment card in violation of the Fair and Accurate Credit Transactions Act (FACTA).
If you paid for goods or services at International Marketplace with a debit or credit card, and your receipt showed more than the last five digits of the payment card number and/or the credit or debit card’s expiration date, you may be entitled to benefits from the FACTA settlement.
Plaintiff Cirena Torres filed the FACTA class action lawsuit alleging International Marketplace willfully and intentionally violated the Fair and Accurate Credit Transactions Act by providing receipts that displayed more than the last five digits or the expiration date of customers’ credit and debit cards. FACTA was passed by Congress in 2003 to assist in the prevention of identity theft and credit and debit card fraud.
International Marketplace denies any wrongdoing and liability but agreed to settle the FACTA class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The International Marketplace class action settlement was preliminarily approved on Oct. 20, 2015.
Who’s Eligible
You are a Class Member of the International Marketplace FACTA settlement if you, at any time from Dec. 31, 2012 through Dec. 13, 2014, were provided an electronically printed receipt at the point of sale or transaction at the International Marketplace store, on which receipt was printed more than the last five (5) digits of your credit card or debit card number and/or the expiration date of your credit card or debit card.
The International Marketplace store is located at 5000 S. Decatur Boulevard in Las Vegas, Nev.
Potential Award
One $50 gift card which may be used to purchase any good or service at the International Marketplace store.
Proof of Purchase
Class Members must submit either an original or copy of a store receipt that shows more than the last five digits of their credit card or debit card number and/or the card’s expiration date, or an original or copy of a credit card or debit card statement showing they made a transaction at the International Marketplace store during the Class Period.
If you are a member of International Marketplace, you may provide your member number.
