Black-Warrior-Electric

A $10.5 million settlement has been reached in a class action lawsuit alleging Black Warrior Electric Membership Corporation failed to distribute “excess revenues” as provided by Alabama law. If you are a current or former member of Black Warrior, you may be entitled to a cash payment from the class action settlement.

Black Warrior is an electric membership cooperative that provides electrical service to businesses and residents in certain Alabama counties. The class action lawsuit alleges Black Warrior violated Alabama law by failing to distribute “excess revenues” as required by section 37-6-20 of the Alabama Code.

Black Warrior denies the allegations and maintains that it did not violate the law. However, it agreed to settle the class action lawsuit to avoid the cost and risk of trial.

Who’s Eligible

The Black Warrior settlement creates two Classes: the Present Member Class and the Former Member Class.

Present Member Class: You are a member of the Present Member Class if you are an individual or entity which was at any time a member of Black Warrior, and who is a member of Black Warrior as of the date of the Final Order and Judgment.”

Former Member Class: You are a member of the Former Member Class if you are an individual or entity which was at any time a member of Black Warrior, but are no longer a member of Black Warrior as of the date of the Final Order and Judgment.

Proof of Purchase

Claimants must provide their account number, address and other information to confirm membership with Black Warrior. Although Class Members are not required to submit identifying documentation with the Claim Form, they may be asked to provide documentation at a later date.

Claim Form Deadline

To Be Determined. According to the settlement documents, the Claims Period will remain open until 90 days after the “Final Settlement Date” as defined in the class action settlement agreement.

The settlement website indicates that a “Final Settlement Date” has not yet been set. “Thus, claims may continue to be submitted past November 10, 2015,” the settlement website states. “We will update this message with further details once a firm date is established for the ‘Final Settlement Date,’ as defined in the Agreement.”
