Detroit Renewable Power LLC and Michigan Waste Energy Inc. have agreed to settle a class action lawsuit filed over the alleged emission of pollutants, air contaminants and noxious odors from one of their facilities. The facility at issue is located at 5700 Russell Street in Detroit.
The defendants have agreed to pay $775,000 into a settlement fund that will benefit Class Members. The proposed settlement will resolve a class action lawsuit that was filed in July 2014 over the alleged emission of pollutants, air contaminants and noxious odors from the defendants’ facility. The plaintiff claims that these emissions into the area surrounding the facility were caused due to the defendants’ conduct.
The defendants deny all charges of wrongdoing but agreed to settle the class action lawsuit to avoid the cost and risk of trial. The Detroit incinerator class action settlement was preliminarily approved on Nov. 10, 2015.
Class Members who wish to object to or exclude themselves from this class action settlement must do so no later than Dec. 10, 2015.
Who’s Eligible
Class Members of the Detroit incinerator settlement include:
- All persons and entities that rented or owned and resided at residential property located within the Class Area at any point in time between July 28, 2011 and the present;
- All persons who provided data sheets to Liddle & Dubin PC regarding the defendants’ emissions; and
- All persons who have made complaints to the MDEQ regarding the defendants’ emissions.
Under the terms of the Detroit incinerator class action settlement, “Class Area” refers to the geographic area within Wayne County, Michigan that is highlighted here.
Potential Award
After the deduction of costs and expenses incurred in the case, attorneys’ fees and incentive awards, the $775,000 class action settlement fund will be evenly distributed to all Class Members who submit an approved Claim Form.

My name is lila dhue,an I reside at 1331 east canfield street,an ive lived here since 2008-to present,an a class action lawsuit was filed but I had no knowledge of said proceedings,I was very sick at the time of the air pollution,an this is a eye opener for me cause this was one of the causes of my illnesses..the case was settled but yet those of us who been residents in this area have been ignored,an in my view purposely inorder to facilitate their intended goals..how do I go about adding myself,filing individually?
