The debt collecting agency Frost-Arnett Company has agreed to pay $90,000 in order to settle a Fair Debt Collection Practices Act class action lawsuit.
Plaintiff Regina Sholinsky filed the Frost-Arnett FDCPA class action lawsuit after allegedly receiving notice that she owed payment for a Urology for Children bill. According to the Frost-Arnett class action lawsuit, when Sholinsky received the collection letter, her account number was visible through the window of the envelope.
The Frost-Arnett FDCPA class action lawsuit argued that this practice is an unfair means to collect or attempt to collect a debt by use of the mail. Sholinsky claims that Frost-Arnett, which is a Tennessee-based collection agency, routinely uses the mail in order to collect consumer debt and should be required to follow the strict debt collecting laws required by the FDCPA.
Sholinsky argued that the FDCPA states that “using any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business.”
Debt collector Frost-Arnett denies the allegations but agreed to settle the FDCPA class action lawsuit in order to avoid the cost and risk of trial.
Who’s Eligible
The Frost-Arnett class action lawsuit settlement is open to all Class Members with addresses within the jurisdiction of the U.S. Court of Appeals for the Third Circuit who, beginning Dec. 19, 2013 through and including the final resolution of this case, were sent one or more letters from Frost-Arnett attempting to collect a consumer debt which showed an account number visible through the window of the envelope.
There are approximately 32,000 members of the Settlement Class.

The Frost-Arnett class action settlement will divide $90,000 equally among all Class Members who file valid and timely claims. If 10 percent of the Settlement Class submits a claim, then each Class Member will receive a check for approximately $28.23.
The Frost-Arnett settlement also states that any un-cashed checks or other leftover funds will be donated to charity.
Proof of Purchase
The Frost-Arnett class action lawsuit settlement requires that Class Members submit a valid claim form in order to receive a cash payment.
