A class action lawsuit has been filed against Sybaris Clubs International Inc. and its owners alleging they violated the Federal Wiretap Act by unlawfully intercepting, recording, archiving and transferring phone calls in and out of reservation lines at Sybaris Suites locations without the consent of the callers.
If you made a telephone call into or out of the reservation telephone line at a Sybaris Suites location from March 19, 2012 to April 11, 2013, your rights may be affected by this call recording class action lawsuit.
Plaintiff Robert C. Burrow initially filed the Sybaris call recording class action lawsuit in March 2013. He asserts that, over a two-year period, individuals were not informed that their calls to or from the reservation desk at Sybaris Suites locations would be recorded. He is seeking at least $10,000 in statutory damages for each individual whose call was recorded without their consent. Sybaris denies the allegations and maintains that it did not do anything wrong.
After attorneys’ fees and administrative costs are deducted from the Settlement Amount, remaining money may be divided per capita among all eligible Class Members who make a claim. If the remaining money is not sufficient to pay at least $10.00 to each Class Member who makes a claim, then the remaining money will be paid, upon Court approval, to appropriate organizations selected by Class Counsel.
Who’s Eligible
The court has certified the following Class: “All persons who made a telephone call into or out of the reservation telephone lines at Sybaris’ five locations between the following dates: (1) Downers Grove, Illinois between March 19, 2012 and April 11, 2013; (2) Northbrook, Illinois between May 11, 2012 and April 11, 2013; (3) Frankfort, Illinois between May 14, 2012 and April 11, 2013; (4) Mequon, Wisconsin between May 25, 2012 and April 11, 2013; and (5) Indianapolis, Indiana between June 15, 2012 and April 11, 2013.”
Potential Award
After attorneys’ fees and administrative costs are deducted from the Settlement Amount, remaining money may be divided per capita among all eligible Class Members who make a claim.
