CVS has agreed to pay $7.46 million to settle wage and hour claims from some of its pharmacists. If you are or were employed by CVS as a non-exempt pharmacist in California from Oct. 2, 2009 through April 30, 2015, you may be entitled to payment from the class action settlement.
This CVS class action settlement will resolve allegations in three separate but related class action lawsuits that alleged causes of action against CVS for failure to pay overtime wages; failure to provide timely, accurate, itemized wage statements; failure to pay earned wages upon discharge; conversion; and unlawful and/or unfair business practices in violation of California law.
According to the wage and hour class action lawsuits, pharmacists who work more than six days in a row are entitled to overtime pay for work beyond the sixth day, regardless of how CVS defines its work week.
CVS denies the allegations but has agreed to settle the class action lawsuits to avoid the risk and expense of proceeding to trial.
The class action lawsuits that will be resolved by this settlement include:
- Timothy J. Connell v. CVS Pharmacy Inc., et al. (CVS Region 65)
- Klara Paksy v. CVS Pharmacy Inc., et al. (CVS Region 54)
- Dale Bystrom v. CVS Pharmacy Inc., et al. (CVS Region 74)
A separate settlement was reached in a similar class action lawsuit (Rimanpreet Uppal v. CVS Pharmacy Inc.) involving California’s Region 73. More information about that class action settlement, including claim filing instructions, can be found here.
UPDATE: On Feb. 2, 2016, a California judge granted final approval of the $7.4 million CVS class action lawsuits.
Who’s Eligible
Class Members of the CVS wage and hour settlement include: “All persons who are or were employed by CVS as non-exempt pharmacists in Regions 54, 65, and/or 74 in the State of California and who worked more than six consecutive days of work without overtime pay from October 2, 2009 through April 30, 2015 (Connell, Region 65), October 4, 2009 through April 30, 2015 (Pasky, Region 54), and October 29, 2009 through April 30, 2015 (Bystrom, Region 74).”
Potential Award
Varies. Class Members will be paid based on the number of “Compensable Workweeks” in which they worked more than six consecutive days without overtime pay.
