A $2.5 million class action settlement resolves allegations Star Financial Bank improperly assessed overdraft fees.
The Star Financial class action settlement benefits current and former bank customers who were charged overdraft fees between March 18, 2011, and June 30, 2024, and who received an email or postcard notice indicating they are entitled to receive a cash payment, credit to their account or forgiveness of uncollected overdraft fees based on Star’s records.
Plaintiffs in the Star Financial class action lawsuit claim the bank wrongly charged and failed to refund overdraft fees, known as APSN fees, on signature-based debit card purchases. They argue the bank applied these fees even when customers had enough money in their accounts when it authorized the transactions but lacked sufficient funds later when it processed and posted them to their accounts.
The plaintiffs assert claims of breach of contract of the account agreement, including breach of the implied covenant of good faith and fair dealing, unjust enrichment and violations of the Indiana Deceptive Consumer Sales Act.
Star Financial Bank is an Indiana bank that offers banking, insurance, trust and wealth management services.
Star Financial denies any liability or wrongdoing but agreed to the $2.5 million settlement to resolve the overdraft fee class action lawsuit.
Under the terms of the Star Financial class action settlement, class members will receive a cash payment, account credit or forgiveness of uncollected overdraft fees, depending on whether they are current or former customers and paid the fees. The estimated amount of forgiven overdraft fees is $1,287,974.17.
The deadline to exclude yourself from or object to the settlement was Oct. 26, 2024.
The final approval hearing is Nov. 19, 2024.
There is no deadline to receive benefits from the class action settlement. If class members do not opt out or exclude themselves, they will receive a cash payment, account credit or forgiveness of uncollected overdraft fees, depending on their relevant situation.
