Somnia agreed to pay $2.425 million to resolve claims it failed to prevent a 2022 data breach that compromised sensitive patient information.

The Somnia settlement benefits individuals who received anesthesiology services from a practice Somnia managed and whose personal information the July 11, 2022, data breach compromised.

Plaintiffs in the Somnia data breach class action lawsuit accused the anesthesiology company of failing to protect their information from the breach. The breach allegedly compromised names, birth dates, driver’s license numbers, Social Security numbers, financial account information, health insurance policy numbers, medical record numbers, Medicaid or Medicare IDs, health information and more.

Somnia is an anesthesia management company that provides services to hospitals and other facilities.

Somnia hasn’t admitted any wrongdoing but agreed to a $2.425 million settlement to resolve the data breach class action lawsuit.

Under the terms of the Somnia settlement, class members can receive up to $2,500 for out-of-pocket losses, including bank fees, credit expenses, identity theft costs and other documented losses. Under this $2,500 reimbursement cap, class members can also claim up to 20 hours of lost time at a rate of $20 per hour for a maximum lost time payment of $400. These payments may be reduced on a pro rata basis depending on the number of participating class members.

Class members who did not experience out-of-pocket losses as a result of the data breach can still receive a pro rata share from the settlement. These class members can receive a default settlement payment of one share if they are not from California or three shares if they are from California. The value of these shares will vary depending on the number of participating class members and other factors.

The deadline for exclusion and objection was Dec. 2, 2024.

The final approval hearing for the Somnia data breach settlement is scheduled for April 28, 2025.

To receive settlement benefits, class members must submit a valid claim form by Jan. 2, 2025.
