Payless ShoeSource Inc. has agreed to settle two class action lawsuits that allege the retailer failed to pay certain employees for all time worked and failed to provide lawful meal and rest breaks. If you work or have worked for Payless ShoeSource in California as a Sales Associate, Greeter or Temp at any time from Oct. 7, 2006 through Nov. 1, 2013, you could receive money from the Payless wage class action settlement.
Who’s Eligible
Class Members of the Payless wage and hour class action settlement include anyone who worked at Payless as a Full-Time Sales/Store Associate, Part-Time Sales/Store Associate, Full-Time Greeter, Part-Time Greeter, and/or Temp during the period from Oct. 7, 2006 through Nov. 1, 2013.
Potential Award
Payless has agreed to pay up to $5 million to settle the claims in the class action lawsuits. If the class action settlement is approved, Class Members who submit a timely and valid Claim Form will receive a minimum of $75. The settlement shares will be a pro-rated percentage of the number of weeks each Class Member worked in each relevant position compared to the total number of weeks worked by all Class Members in relevant positions.

Case Summary
If approved, the Payless wage and hour settlement will resolve two class action lawsuits (Atkins, et al. v. Payless ShoeSource Inc., et al. and Guevara, et al. v. Payless ShoeSource Inc., et al) that allege Payless failed to pay employees for all the time they spent working (including time spent working off the clock), failed to provide lawful meal and rest periods, failed to reimburse expenses and failed to pay all wages owed upon termination of employment.
The Payless class action lawsuits also allege Payless did not provide its employees with accurate, itemized pay stubs and did not maintain accurate payroll records. They allege these practices violated the California Labor Code and the Unfair Business Practices Act.
Payless denies the allegations but has decided to settle the class action lawsuit to avoid the expense and uncertainty of trial.
