$18.7M Aspen Dental privacy class action settlement

Aspen Dental agreed to pay more than $18 million to resolve claims it violated consumer privacy rights by using tracking pixels on its website.

The Aspen Dental settlement benefits individuals who booked an appointment on the Aspen Dental website between Feb. 20, 2022, and Jan. 1, 2025.

There are two groups within the settlement class:

• Group 1: Individuals who booked an appointment between Feb. 20, 2022, and June 1, 2023
• Group 2: Individuals who booked an appointment between June 2, 2023, and Jan. 1, 2025

The Aspen Dental class action lawsuit alleged that the company may have violated consumer privacy rights by using Meta and Google tracking pixels on its website to collect sensitive information about visitors and shared this information with third parties. The plaintiffs in the case claim that this practice violated privacy laws.

Aspen Dental has not admitted any wrongdoing but agreed to pay $18.7 million to resolve the allegations.

Under the terms of the Aspen Dental class action settlement, class members can receive a cash payment based on their class group.

Group 1 class members can receive a pro rata share of the net settlement fund. Exact payments will vary depending on the number of claims filed with the settlement. Group 2 class members will receive a flat-rate payment of $15. Payments may be reduced on a pro rata basis depending on the number of claims filed with the settlement.

The deadline for exclusion and objection is Sept. 15, 2025.

The final approval hearing for the Aspen Dental data privacy settlement is scheduled for Oct. 20, 2025.

To receive a settlement payment, class members must submit a valid claim form by Sept. 15, 2025.

Who’s Eligible

Group 1 class members are individuals who booked an appointment on aspendental.com between Feb. 20, 2022, and June 1, 2023. Group 2 class members are those who booked an appointment on aspendental.com between June 2, 2023, and Jan. 1, 2025.

Potential Award

For Group 1, payments vary, while for Group 2, up to $15.
