Details: The AT&T DSL settlement will resolve a class action lawsuit, entitled Schmidt v. AT&T and SBC Internet Services, Inc., alleging that AT&T failed to deliver DSL service to its customers at the speeds promised. Specifically, the class action lawsuit alleges that AT&T breached its contract with and defrauded some of its customers by limiting the maximum data speed that some of its customers could obtain to a rate below the maximum rate for the plan the customer purchased. The class action lawsuit also alleged that AT&T breached its contracts with and defrauded some of its customers by delivering speeds lower than the minimum promised under the customer’s plan, or otherwise disappointed its customers’ expectations regarding the speed of the DSL Service.

AT&T denies the allegations but has agreed to a class action lawsuit settlement to avoid ongoing litigation.

Class Members of the AT&T DSL speed class action settlement include current and former customers of AT&T who paid for DSL service from AT&T or a related affiliate between March 31, 1994 and January 27, 2012.

Related affiliates include, but are not limited to: SBC Internet Services, Inc., d/b/a AT&T Internet Services; BellSouth Telecommunications, Inc.; Pacific Bell Internet Services; Southwestern Bell Internet Services, Inc.; Ameritech Interactive Media Services, Inc.; SNET Diversified Group, Inc.; Prodigy Communications Corporation; and Oklahoma Internet Online.

As a Class Member, you’re entitled to receive one of the following benefits from the AT&T DSL speed class action lawsuit settlement:

— If AT&T’s records show that, for one or more months, the speed of your DSL Service was limited to a rate below the maximum rate for the plan you purchased, you may be eligible to receive $2.90 for each such month.

— If AT&T’s records show that, for one or more months, your DSL Service may have performed at speeds lower than certain speed thresholds specified in the settlement, you may be eligible to receive $2.00 for each such month.

— If AT&T’s records show that your DSL Service fell into both of the categories above for one or more months, you may be eligible to receive $2.90 for each such month.

— If AT&T’s Records do not indicate that you fall into one of the categories above, but you believe that your DSL Service has not performed at satisfactory speeds, you may still be eligible for a one-time payment of $2.00.

Note: Certain AT&T customers who purchased Express DSL service in the states of Missouri, Oklahoma, Kansas, Arkansas and Texas are eligible for different monthly benefits. For more information on the settlement terms applying to these customers (the “Ford and Dunne subclass”), and to submit a claim if you think you might be one of these customers, click here.

    I am looking to sue At & t. My dsl for years was not what they said it would be. In Jan 2012 I ‘upgraded’ to uverse which was not any better. They have since admitted that uverse doesn’t even come to my home although I have been paying for it for over a year. This statement doesn’t even begin to tell of all that has been going on. I need an attorney.

    Just spoke to AT&T to get more info on “DSL Speed Credit Settlement” on my Sept 2012 bill. They won’t comment but on DSLSpeedSettlement.com I found some info about this class action suit settled in 2009. Yes, they admit to not providing advertised speeds and are issuing refunds ($2.90/mo, which seems awfully low). But they are also downgrading my service to the slowest speed “Basic” for $25/mo. and will not now offer service I had purchased “Express.” Instead they offered their “U-Verse” but I’m leery of them. I’m trying to find out if this reduction in service is covered in the court case but cannot reach a live person. Everything points to having to snailmail someone with questions…..!

    Absolute worst service ever! 1 MBS at max frequently drops out. Their customer service are people out of India that lie about the ATT service saying it’s all good when it is not. This is a horrible service that has grown much worse as I have used them. This company is going down, ditch ATT as soon as you can. This is a mis managed (too big for it’s britches) garbage company. They do no want to spend money upgrading their lines instead their CEO’s want to spend money on Gold toilet bowl seats. !

    For five years now I’ve had speeds on ST&T DSL slower than my previous dial ups. After reading about this lawsuit I’m really pissed because AT&T said it was because our computer was too old so we purchased a new one.

    The same things happen and 1/2 the time we can not even get online. We live in Rohnert Park, California.

    I’m switching all of our services to AT&T’s major competitor tomorrow. Wish I had a punching bag right now, I’m so mad!

    We have had ongoing interruptions in service almost daily,as well as slowed speeds constantly.after reporting this problem many times they just changed ports or said it was temporary,we have had this service over a year and still no resolve.

    AT&T has never met its committment with regular DSL and Uverse service. This is important in that I have been with AT&T since the 90s. The loads and down downloads do not meet their claims. It is also important that when you talk to their Support folks they tell you can get faster speed even when the lines will not support it. An even greater lawsuit will be the number of times your service can not be accessed cause of their failure and you have to reset your modem.

    We were a AT&T customer from 1997 to 2009 we had what they called the fasted DSL which was very slow and half the time we could’nt get on the internet ,we had called customer service about the problem several times and they would come out and try to speed it up but it never would so we just lived with it till we could find something in our area better.
