Body Shop class action settlement

The Body Shop has reached a class action lawsuit settlement over allegations that the cosmetic and skin care retailer violated the Telephone Consumer Protection Act.

Lead plaintiff Aimee Lambert filed the TCPA class action lawsuit against Buth-Na-Bodhaige Inc. (under the trade name The Body Shop) after allegedly receiving numerous unsolicited text messages.

According to The Body Shop class action lawsuit, Lambert received text spam from the company in October 2013. The first unsolicited text message reportedly read: “Welcome! The Body Shop will send you exclusive offers shortly. Consent is not required for purchase.” Later that the same day, another text spam message allegedly arrived, which read: “The Body Shop: Get an additional 20% OFF when you shop in-store through 10/20/13.”

The Body Shop lawsuit claims that the company negligently or intentionally violated the TCPA which makes unsolicited text messages without prior express written consent illegal. The Body Shop denies any wrongdoing but has agreed to settle the TCPA class action lawsuit that is estimated to affect more than 225,000 individuals.

Who’s Eligible

Class Members include those individuals who received a text message sent from, or on behalf of, The Body Shop between Feb. 20, 2010 and Feb. 20, 2014, as reflected by defendants’ combined records.

Potential Award

$25 Gift Card

The Body Shop will mail or email a $25 electronic gift card to all settlement Class Members. The gift card can be redeemed in stores or online and may even be given to another person. There will be no expiration date or minimum purchase amount required to use The Body Shop gift card.

Proof of Purchase

No proof of purchase is required to receive compensation.

Claim Form Deadline

N/A

There is no claim form deadline but if class members wish to be excluded from the settlement there is a deadline of 10/13/2015.

If you receive notice of this Body Shop settlement in the mail or by email, then you are a “known class member” and will be sent the settlement gift card without doing anything further.

If you did not receive notice of the Body Shop TCPA class action settlement but you believe you should be a Class Member, you may fill out the Contact Form on the settlement website to ask to be included.

      The settlement was granted final approval by the court on November 20, 2015. There were no appeals filed. The settlement website is no longer active.
