Consumers nationwide who had or have a checking account with American Airlines Federal Credit Union and were charged certain fees may be eligible for compensation in the form of a payment thanks to a recent $1.59 million class action settlement.

Settlement Class Members include current or former consumers who owned a checking account through American Airlines Federal Credit Union. These Class Members were charged overdraft fees between May 14, 2016, and Oct. 8, 2020, or nonsufficient funds (NSF) fees between May 14, 2016, and Feb. 29, 2020.

The plaintiffs in a class action lawsuit allege American Airlines Federal Credit Union charged improper APPSN fees, retry NSF fees, and overdraft fees between May 14, 2016, and Oct. 8, 2020. The company’s actions, according to the plaintiffs, resulted in a breach of contract and a breach of the good faith dealing between it and the plaintiffs.

American Airlines Federal Credit Union denies any wrongdoing or legal liability. It confirms it charged the fees alleged by the plaintiffs, but asserts all fees charged were done so in accordance with the terms of its agreements and the law. 

The Court has not made a judgment in this case, so there hasn’t been a determination of guilt. Both the plaintiffs and the defendants have determined the proposed settlement agreement is in their best interests.

As of September 2015, American Airlines Federal Credit Union had more than 296,000 members and 47 branches throughout the United States, according to its LinkedIn page.

Eligible Class Members will receive a share of the $1.59 million settlement fund. 

First, service awards, attorneys’ fees, and other expenses will be taken care of. The remainder will be distributed to Class Members. 

American Airlines Federal Credit Union has also agreed to forgive more than $175,807 in uncollected overdraft fees without further action from the Class Member.

The deadline for Class Members to opt out of the settlement has passed.

Class Members have the right to object to the proposed settlement agreement by Nov. 16, 2021.

A final fairness hearing in the American Airlines Federal Credit Union class action lawsuit is scheduled to take place on Dec. 13, 2021.

Class Members do not need to file a claim form in order to participate in this settlement.
