Alaska Credit Union Class Action Settlement

Consumers who had an Alaska USA Federal Credit Union account and were charged certain retry fees may be eligible for compensation in the form of a one-time payment thanks to a recent $836,000 class action settlement.

Settlement Class Members include individuals who have or had an Alaska USA Federal Credit Union account and were charged either certain retry fees between Nov. 1, 2016, and Sep. 30, 2019. 

Alaska USA Federal Credit Union account holders who created their accounts after Oct. 1, 2018, are not considered Class Members.

Retry fees include check transactions re-submitted by a merchant after being rejected for insufficient funds and non-sufficient fund fees for automated clearing house and check transactions, according to the class action lawsuit. 

In the class action lawsuit, the plaintiffs allege they were unfairly charged the retry fees. These charges, the plaintiffs allege, violated Alaska’s Unfair Trade Practices Act, breached their contract with the company, and should be considered unjust enrichment of the company.

The company does not deny levying specific retry fees, but it does deny those fees were illegal or outside of the terms of its agreements. The company denies any wrongdoing. 

The Court did not make a ruling in this case. There is still legal uncertainty surrounding the legality of the fees. Despite that, both parties believe the settlement agreement serves the best interests of everyone involved.

Class Members are eligible to receive a payment from the $836,000 settlement fund.

The exact payment that will get distributed to each Class Member either as a credit to their account or as a check from the settlement administrator will be determined using formulas outlined in the settlement agreement.

 Class Members will also have uncollected retry fees forgiven.

The settlement fund will also be used to pay all attorneys’ fees, costs awarded to Class Counsel, settlement administration costs, service awards to class representatives. The defendants are not responsible for any other payments.

Class Members have the right to exclude themselves from the settlement agreement. Doing so means that the Class Member will not be eligible to receive a payment, but they will maintain the right to pursue individual litigation later on. 

The deadline to request exclusion is Oct. 18, 2021.

The deadline for Class Members to object to the settlement is also Oct. 18, 2021.

A final approval hearing is scheduled for Nov. 16, 2021.

No claim form is required for participation in this settlement.

    I was a member when then happened . This was for a $9.95 gym membership was supposed to be canceled from gym and I was transitioning personal bills to a different account and a my Alaska Account for business. The gym membership was not canceled as requested and was informed I had to do it at the location in person. Unfortunately the gym tried to process my monthly pay when I had the account cleared at $0.00. I discovered this by seeing a negative balance of over $500.00. I had no clue how it happened . Alaska USA told me it was for nsf fees for the $9.95 attempted transaction. I asked for a forgiveness since it was only 9.95 and it was supposed to be canceled. They informed me that I would have to dispute it with my gym as my gym was the culprit that kept trying. I was, upset how Alaska USA did not protect me in this instant and block any suspicious activity and how they could let it happen seconds after each other in groups of 10, 20, plus 4 days in a row. Those many Retrys we’re accompanied by the $25 NSF. Never had issues. I refused to pay it. They put me on check systems . And created other issues with auto pay pending accounts which created more negative balances and issues with my accounts. They wanted all the money . No remorse. They were helpful and awesome before . Now they turn their backs on Me.

    Been following the case . Happy when we won. Been checking in with bank . Lack of communication, lack of information, but said I still owe them $ 389.00.
    Claimed because of other NSF payments that didn’t go through.

    I argued that was, due to their illegal , policy breach and not my obligation.
    Then I got the run around, lack of information, etc.

    Finally went to Branch. Found out that they refunded me $25. For the 1st NSF. Some of my amount has been sent to collections so there is more work , I’m still on check systems and the rest are from the NSF that stacked on.

    They are still practicing unfair policies, not following their court ordered law suit and still blaming it all on me. What good did this law suit do if I only came to getting a refund of the orgininal NSF, I could have paid that and never been put in the situations they put me in and stil. Should I also get any refund and compensation from any negative impact that I have suffered due to the exact reason this ruling ordered the bank to fully refund all accounts involved.

    This needs to be investigated. They are breaking the law still . Are there any follow ups to this case? Anyone getting the the same ?

    Anyone else not get anything since initial email that statedhow much youd get, have been emailing them an there ignoring them, but somehow send me emails trying get me take out another loan with them.
