Citizens residing in Roseville, Michigan, who paid stormwater charges between Jan. 1, 2019, and June 30, 2021, may be eligible to receive a cash refund or credit on their sewer account thanks to a $2.4 million class action settlement.

The settlement Class includes all citizens or entities that paid for stormwater disposal services in the city of Roseville between Jan. 1, 2019, and June 30, 2021. These Class Members paid or incurred the stormwater charges.

According to the class action settlement, the plaintiffs allege the city of Roseville unfairly and unjustly levied “Stormwater Charges” against settlement Class Members. 

These charges, the plaintiffs argue, were not proper user fees but taxes meant to raise the city’s revenue. Additionally, the plaintiffs say the city was unjustly enriched by the taxes, while settlement Class Members were harmed by them.

A similar class action lawsuit in Michigan regarding stormwater charges recently settled for $2.6 million.

The city of Roseville alleges the “Stormwater Charges” were proper and not unlawful taxes. 

The Court has not made a determination of guilt or gone over the merits of the lawsuit. After considering the advantages and disadvantages of ongoing litigation, both parties agreed to a $2.4 million settlement.

Class Members who have a current water and sewer billing account with the city of Roseville will receive a credit on their account. 

Each Class Member will receive a pro rata share which will reflect on their accounts. This share will vary depending on the total amount of charges the Class Member paid, the total amount of charges the city collected from Class Members, and the total amount of the net settlement fund.

Class Members who paid the stormwater charges but don’t have an account must submit a claim.

Class Members who want to participate in this class action settlement but want a cash refund must file a claim. This claim must document the name, addresses, and time periods in which the stormwater charges were paid. Class Members who make a claim qualify to receive a distribution of cash via check.

A final hearing is scheduled to take place Dec. 6, 2021.

The deadline for Class Members to file an objection or exclude themselves from this settlement is Oct. 7, 2021. A failure to object or request exclusion from the settlement Class means the Class Member won’t be eligible to pursue future legislation regarding this class action lawsuit.

The deadline to file a claim is Oct. 7, 2021.

All citizens or entities that paid for stormwater disposal services in the city of Roseville, Michigan, between Jan. 1, 2019, and June 30, 2021.
