TOPGOLF FINGERPRINT SCANNER SETTLEMENT UPDATE:

Topgolf has agreed to a $2,633,400 settlement to benefit certain individuals who used a biometric fingerprint scanner to clock in and out of work.
The Class includes all Illinois employees who used a biometric fingerprint or finger scanner at Topgolf venues in Illinois between March 4, 2014, and June 22, 2021, without first signing a biometric consent form.
The class action lawsuit had argued Topgolf violated the Illinois Biometric Information Privacy Act, or BIPA, because it did not provide written notice to employees or obtain their written consent before collecting their fingerprint data. In addition, the plaintiffs alleged Topgolf did not destroy the fingerprint data in a timely fashion.
Among other things, BIPA bars companies from obtaining, storing, transferring, and/or using a person’s biometric information, such as fingerprint scans, without providing them with written disclosures and obtaining written consent from that person.
Topgolf has denied these accusations, and a Court has not ruled in either party’s favor. Instead, the parties have agreed to the settlement to avoid the risk and cost of ongoing litigation.
Topgolf is an entertainment destination that offers food and drinks, music, and golf hitting bays. The company has dozens of locations throughout the United States, as well as in the U.K., Australia, Germany, Mexico, and the United Arab Emirates.
The Illinois Topgolf locations are in Naperville and Schaumburg, both in the Chicago area.
Topgolf Settlement Benefits
After attorneys’ fees and other expenses are paid, Class Members will be eligible for a proportionate share of the net settlement fund.
The parties in the class action estimate each Class Member will receive a payment of approximately $630.
A final hearing in the Topgolf settlement will be held Oct. 13, 2021.
The deadline to request to be excluded from the settlement — or to object to it — is Oct. 2, 2021.
No claim form is required for this settlement.
