Personnel Staffing Group LLC, doing business as MVP, has agreed to a $76,000 settlement resolving claims of race discrimination at its Cicero, Illinois, office.
The Class is made up of all African Americans who sought work assignments through Personnel Staffing Group LLC, doing business as MVP, at its Cicero office at any point between Dec. 6, 2012, and April 19, 2021, but who, on one or more occasions, were not assigned to work at MPS Chicago Inc. by Personnel Staffing Group LLC doing business as MVP.
Plaintiffs in a class action lawsuit had alleged they and others sought job assignments through the agency but were not assigned to work at Segerdahl, Mercury, Penray, ARI, Lawrence Foods, or MPS on the basis of their race, and were therefore financially harmed through loss of wages.
Personnel Staffing Group denies all allegations of wrongdoing related to the race discrimination class action lawsuit.
The Court has not ruled in favor of either party; instead, both parties have agreed to the settlement to avoid the uncertainty of ongoing litigation.
Personnel Staffing Race Discrimination Settlement Benefits
If the Court approves the settlement, Class Members who submit a valid claim form will be eligible to receive a proportionate share of the net settlement fund.
The amount of each Class Member’s payment will depend on the number of claims filed.
Under the terms of the settlement agreement, 50 percent of each Class Member’s payment will be considered wages and reported to the U.S. Internal Revenue Service (IRS) Form W-2.
The remaining 50 percent will be considered compensatory damages and will be reported on an IRS Form 1099 where required.
Federal, state, and other taxes will be deducted from the payment, as will the Class Member’s share of Federal Insurance Contributions Act (FICA) taxes.
Claimants are solely responsible for the reporting and payment of their share of any taxes on payments received from the settlement.
A final approval hearing in the Personnel Staffing Group race discrimination settlement will take place Oct. 19, 2021.
The deadline to opt out of or object to the settlement is Aug. 30, 2021.
The claim deadline is also Aug. 30, 2021.
