Current and former Robert Heath Trucking employees who were paid piece rate by the mile may be eligible to benefit from a $245,000 class action settlement.
The Class is defined as anyone who is or was previously employed by Robert Heath Trucking in California as a truck driver and was paid piece rate by the mile between Aug. 30, 2015, and Sept. 1, 2020.
In addition, a Private Attorney General Act (PAGA) Group is made up of all individuals currently or previously employed by Robert Heath Trucking in California who were paid piece rate by the mile between Sept. 3, 2018, and Sept. 1, 2020.
The plaintiff in a class action lawsuit had alleged Robert Heath Trucking violated the Unfair Competition Law and labor laws by failing to provide required meal periods and pay timely and minimum wages, among other things.
Robert Heath Trucking, based in Dallas, focuses on transporting California produce throughout the central and western United States.
The company denies any liability or accusations of wrongdoing; however, the parties have agreed to the settlement to avoid the inconvenience and cost of continuing litigation.
The estimated 101 Class Members will receive a share of the settlement fund after attorneys’ fees and other deductions have been made.
Assuming all Class Members participate, each person’s average payment is expected to be about $1,320.13.
In addition, PAGA Group Class Members also each will receive a portion of the PAGA penalty, which is estimated to be a payment of approximately $24.75.
The settlement administrator will arrive at the payment amount by adding up the total number of workweeks for all Class Members.
They will then divide the respective workweeks for each Class Member by that total, which will result in the payment ratio for each Class Member.
That ratio will then be multiplied by the net settlement amount to determine each Class Member’s individual payment.
These payments may be reduced by any required tax withholdings, such as payroll taxes.
A similar method will be used to calculate PAGA penalty payments.
Class Members do not need to file a claim form in order to receive a payment.
A final approval hearing will take place Sept. 16, 2021.
The deadline to request to be excluded from or to object to the settlement is July 23, 2021.
