Gregory Funding has agreed to a $200,000 settlement benefiting individuals who received mortgage statements that may have misrepresented the borrower’s suspense account balances.

The Class is made up of anyone who received a monthly statement from Gregory Funding that allegedly violated the law on or after May 18, 2016, but before May 1, 2017. 

The plaintiff in a class action lawsuit had alleged the misrepresentations on the Gregory Funding monthly mortgage statements violated the federal Fair Debt Collection Practices Act (FDCPA) and the Truth in Lending Act (TILA).

Gregory Funding, based in Tigard, Oregon, services residential and loans throughout the United States, according to the company’s website.

The company has denied any wrongdoing but has agreed to the settlement to avoid the continuing costs and risks associated with litigation.

Class Members who have a mortgage that Gregory Funding is still servicing will receive their payment as a credit posted automatically to the unpaid balance on their mortgage.

Class Members whose mortgage is no longer being serviced by Gregory Funding must submit a claim form in order to receive a payment.

Each Class Member who files a valid claim will receive an equal share of the settlement fund after attorney’s fees, administration costs, and other expenses are paid.

None of the $200,000 settlement fund will revert to Gregory Funding. If checks remain uncashed after 180 days, the unclaimed funds will be donated to the Juvenile Diabetes Research Foundation.

The deadline to opt out of or object to the settlement is July 23, 2021.

The claim form deadline also is July 23, 2021.

Who’s Eligible

Anyone who received a monthly statement from Gregory Funding that allegedly violated the law on or after May 18, 2016, but before May 1, 2017.

Each Class Member who files a valid claim will receive an equal share of the settlement fund after attorney’s fees, administration costs, and other expenses are paid.

    They have been putting me on hold for 2 1/2 hours just to let me know they cannot read one of the documents that I have submitted for the the last 2 years. I get hung up on after waiting 2 hours to speak to someone, the are avoid to help us and our family due to covid. Very frustrating and sad

    I am just finding out about this class action suit. It is May of 2023. I am curious as I did qualify as a complainant and had mortgage problems with Gregory funds that I was not advised or notified.

    Late paying home taxes and will not return any phone calls. Called back to back for days and no response

    I’m at a lose with this company. I’ve tried many time to reach them, I even stop paying for two months so they will call. They didn’t. Not sure what to do next but feel like I’m being robbed. They added $10k to my loan.
