DRIZLY SETTLEMENT UPDATE:

Consumers whose personal information may have been affected by a data breach at alcohol delivery service Drizly may be eligible to claim a $14 payment without providing proof of purchase thanks to a $7.1 million class action settlement.

The Class is made up of anyone in the United States whose customer data was compromised during the data intrusion security incident Drizly made public on July 28, 2020, in which an unauthorized party accessed certain personally identifiable information of Drizly’s customers.

A class action lawsuit had alleged Drizly’s security measures were not sufficient to protect consumers’ personal information, and as a result of the data breach those customers have been exposed to fraud, identity theft, and other injury.

Drizly is the largest online alcohol delivery marketplace in North America, with retail partners in more than 1,400 cities, according to the company’s website.

Drizly has agreed to pay between $1.05 million and $3.15 million to claimants, no more than $447,750 in account credits, and up to $1.2 million in attorneys’ fees, in addition to taking data security measures valued at $2.3 million.

If the Court approves the settlement, each Class Member who submits a valid claim form will receive a payment of $14. The final payment amount could increase or decrease depending on the number of claims filed.

In addition, the settlement provides Class Members with a $1.99 credit against Drizly’s service fee on orders placed through the platform. That number may also be reduced proportionately depending on the number of claims.

Also as part of the Drizly settlement, the company has agreed to adopt or maintain certain data security measures for at least two years.

No proof of purchase is required, but a claimant code is needed in order to file a claim. The code can be found on the notice the Class Member received from the settlement administrator.

Payments will be distributed after the fairness hearing and after any appeals are resolved.

A final approval hearing in the Drizly settlement is scheduled for Oct. 26, 2021.

Those who would like to opt out of or object to the settlement must do so by July 28, 2021.

The deadline to file a claim is also July 28, 2021.
