Current and former residents of an area in Peshtigo, Wisconsin, may be eligible to benefit from a $17.5 million Tyco Fire Products settlement if a private well provided their drinking water.
The Class includes anyone who, between Jan. 1, 1965, and Dec. 31, 2020, resided in or owned a property with a private well drinking-water source within the area bounded on the north by University Drive, on the south by Heath Lane, on the west by Roosevelt Road, and on the east by the Bay of Green Bay, all in the town of Peshtigo, Wisconsin, for at least one year.
The Tyco Fire Products settlement is part of a multidistrict litigation accusing Tyco, Chemguard Inc., and ChemDesign Inc. of contaminating private wells with per- and polyfluoroalkyl substances (PFAS) through their firefighting foam.
PFAS are manmade chemicals containing carbon, fluorine, and additional chemicals.
Testing of the foam at the Ansul Fire Technology Center allegedly began around 1965, which is why the Class Period begins Jan. 1 of that year.
Peshtigo lacks a municipal water system, and as such, many properties’ drinking water is provided via wells.
Peshtigo Tyco Fire Products Settlement Benefits
The Tyco Fire Products settlement provides Class Members with payments to resolve claims for damages due to exposure to PFAS, even if they do not have proof of an injury, as well as payments to resolve claims for personal injuries.
Class Members may file up to three claims: a property ownership Claim, an exposure claim, and a personal injury claim.
The amount each Class Member filing a property ownership or exposure claim will receive will depend on whether they own the property now or owned it in the past and on the amount of PFAS in the property’s well.
Payments for exposure will range from $1,000 to $6,500, while payments for property ownership claims range from $4,000 to $65,000.
A chart on the settlement website can help Class Members estimate what their payment would be.
Any amount to be paid for personal injury claims, which are separate from Class claims, will depend on the number of such claims that are made and the types of injuries suffered and cannot be determined until all claims have been received.
However, it is estimated each person who files an eligible personal injury claim will receive a minimum of $50,000.
A fairness hearing on the Tyco Fire Products settlement is set for May 24, 2021.
The deadlines for Class Members to opt out of or object to the settlement have passed.
The claim form deadline for property and exposure damages is Oct. 6, 2021.
Who’s Eligible

Proof of Purchase
- Proof of residency in the Class Area at any point between Jan. 1, 1965, and Dec. 31, 2020, from at least one of the following: state-issued identification with address (such as a driver’s license), utility bills, other types of bills or bank statements, or mail addressed to the Class Member at the affected property’s address.
- Any documents, if available, demonstrating PFAS testing results on the relevant private well during the Class Period.
