Were you an adult smoker who, as of Oct. 1, 2006, were assigned a registration number by R.J. Reynolds Tobacco Company and collected and held Camel Cash “C-Notes”? If so, you could be a member of a class action lawsuit settlement.

A California federal judge has certified the class action lawsuit Sateriale, et al. v. R.J. Reynolds Tobacco Co., et al., which alleges that R.J. Reynolds (“RJR”) broke a contract with customers by slashing merchandise from its “Camel Cash” promotion.

RJR conducted the Camel Cash promotion from Oct. 1, 1991 through March 31, 2007. During that period RJR attached Camel Cash “C-Notes” to packages of Camel-brand filtered cigarettes. These certificates were redeemable by consumers for various items of merchandise listed in catalogs distributed by RJR after they filled out an enrollment form and registered for the Camel Cash program.

“Defendant stated that quantities of merchandise were ‘limited,'” however, as of Oct. 1, 2006, RJR “breached the contract by failing to provide any merchandise or catalogs,” plaintiffs allege in the class action lawsuit.

The Court has ruled that adult smokers entered into a contract with RJR by purchasing Camel cigarettes and saving the C-Notes. Plaintiffs are claiming breach of contract regarding the final six months of the Camel Cash program from Oct. 1, 2006 through March 30, 2007.

UPDATE: On Jan. 8, 2016, the plaintiff filed a motion seeking preliminary approval of a settlement which would resolve the Camel Cash class action lawsuit.

UPDATE 2: On Feb. 9, 1016, Top Class Actions received new details regarding the Camel class action settlement. The final hearing date has been set for May 2, 2016. The objection deadline has been set for April 11, 2016. A new settlement website has been established for this case, www.CamelCashSettlement.com. And the potential award for Class Members has been determined to include non-tobacco merchandise.

UPDATE 3: On May 5, 2016, the Court granted final approval of the Camel Cash class action settlement.

Who’s Eligible

You are included in the Camel Cash class action lawsuit if you were in California, as an adult smoker, and were assigned a registration number by RJR, collected C-Notes, and held C-Notes as of Oct. 1, 2006.

Potential Award

Non-Tobacco Merchandise.

The Camel class action settlement will award Class Members the opportunity to use Camel Cash for non-tobacco merchandise.

Do nothing and automatically be part of the Class. You are automatically part of the Class if you meet the Court’s class definition, above. By remaining in the class, you may be entitled to a share in any proceeds if there is a recovery. You will also be bound by any judgment in the Class Action, whether it is favorable or unfavorable.

Class Members can also object to the settlement by sending a letter that includes: (1) your full name, address, telephone number, and PID; (2) a signed declaration that you believe yourself to be a member of the Settlement Class; (3) the specific grounds for your objection; (4) all documents or writings that you desire the Court to consider; and (5) a statement regarding whether you (or counsel of your choosing) intend to appear at the Fairness Hearing. Your objection and any supporting papers must be filed with the Court and mailed or delivered to Class Counsel and RJR’s counsel at the following address, postmarked no later than April 11, 2016:
