Builders Mutual Insurance Co. agreed to a $1.475 million class action lawsuit settlement to resolve claims it failed to prevent a 2022 data breach that compromised sensitive employee and policyholder information.
The Builders Mutual settlement benefits individuals whose private information the data breach compromised in December 2022.
According to the data breach class action lawsuit, Builders Mutual failed to implement adequate cybersecurity measures to protect sensitive information from unauthorized access. As a result, the plaintiffs and other class members had their names, Social Security numbers, health information, insurance data and other sensitive information compromised in the Builders Mutual breach.
Builders Mutual is an insurance company that provides coverage for builders, contractors and other similar businesses.
Builders Mutual hasn’t admitted any wrongdoing but agreed to pay $1.475 million to resolve the data breach class action lawsuit.
Under the terms of the Builders Mutual settlement, class members can receive credit monitoring services and compensation for unreimbursed economic losses and lost time.
The credit monitoring includes three years of one-bureau credit monitoring, dark web monitoring, real-time inquiry alerts and $1 million in identity theft insurance. Class members who experienced fraud or identity theft as a result of the Builders Mutual data breach can receive up to $10,000 in compensation for out-of-pocket costs, professional fees, credit expenses and other losses. Class members can also receive up to six hours of lost time at a rate of $25 per hour for a total of $150 in lost-time compensation.
Class members can choose to receive a cash payment instead of credit monitoring and expense reimbursement. Claimants who choose this option will receive an estimated $100 payment. However, these payments may be increased or decreased on a pro rata basis depending on the number of claims filed and the amount of funds available for distribution.
The deadline for exclusion and objection was Dec. 9, 2024.
The final approval hearing for the settlement is scheduled for Jan. 17, 2025.
In order to receive settlement benefits, class members must submit a valid claim form by Jan. 8, 2025.
