Wells Fargo and HSBC Bank USA have agreed to pay $1.3 million as part of a class action lawsuit settlement to resolve claims they sent misleading letters to borrowers about mortgage payments during COVID-19 forbearance.
The Wells Fargo settlement benefits borrowers with Wells Fargo home mortgage accounts who have a West Virginia mailing address or property located in West Virginia and participated in COVID-19 forbearance. These borrowers received a letter between March and December 2020 discussing the consequences of missed COVID-19 forbearance payments at the end of the loan period. The settlement class consists of around 2,010 accounts identified by Wells Fargo.
Plaintiff David Kirkpatrick accused Wells Fargo and HSBC of sending misleading letters to consumers about the movement of mortgage payments to the end of the loan term during the COVID-19 forbearance program.
Wells Fargo is a national bank that offers various financial services, including home mortgages. HSBC is a global bank with a presence in the United States.
Wells Fargo and HSBC have not admitted any wrongdoing but agreed to a $1.3 million class action lawsuit settlement to resolve the allegations.
Under the terms of the Wells Fargo settlement, class members are eligible to receive a cash payment. According to the settlement website, each class member is anticipated to receive up to $400 per account. However, this is only an estimate, and actual payments may be higher or lower.
The deadline for exclusion and objection is Dec. 22, 2025.
The final approval hearing for the Wells Fargo COVID Forbearance program class action lawsuit settlement is scheduled for Feb. 20, 2026.
No claim form is required to benefit from the settlement. Class members who do not opt out by the Dec. 22, 2025, deadline will automatically receive settlement benefits.
