SunWest Milling and SunWest Foods agreed to a $1.2 million class action lawsuit settlement to resolve claims they violated California wage and hour laws by denying workers wages and other owed benefits.

The SunWest settlement benefits anyone who worked for SunWest Milling and SunWest Foods in California as a non-exempt employee or temporary worker through an agency between July 21, 2019, and Sept. 18, 2024.

The settlement also includes a Private Attorneys General Act class of workers employed by the defendants as non-exempt employees or temporary workers through an agency in California between July 21, 2022, and Sept. 18, 2024.

The wage and hour class action lawsuit claims SunWest violated California labor laws by failing to pay minimum and overtime wages, violating meal and rest period regulations, failing to provide timely and accurate wage statements and failing to pay wages in a timely manner upon termination of employment. Plaintiffs filed their claims under California labor laws, including PAGA, a California law that allows workers to sue on behalf of the state’s labor board.

SunWest Milling and SunWest Foods are grain and food companies based in California.

SunWest hasn’t admitted any wrongdoing but agreed to the $1.2 million class action settlement to resolve the wage and hour class action lawsuit.

Under the terms of the SunWest settlement, class members can receive a pro rata payment calculated by dividing the net settlement amount by the total number of workweeks worked by all participating class members during the class period and multiplying the result by each participating class member’s workweeks. 

PAGA class members will receive an additional pro rata share of the settlement’s PAGA fund.

No payment estimates are available at this time but may have been sent with mailed settlement notices.

The deadline for exclusion and objection is Dec. 23, 2024.

The final approval hearing for the settlement is scheduled for Feb. 19, 2025.

No claim form is required to benefit from the settlement, but class members can contact the settlement administrator to dispute the workweek/pay period estimates found in their notices until Dec. 23, 2024.
