APi Inc. agreed to pay $1.05 million to resolve claims it failed to pay its Pennsylvania workers proper overtime wages.

The APi settlement benefits non-exempt employees of APi Inc., APi Construction Co. or APi Group Inc. who worked at the Shell Cracker Plant in Monaca, Pennsylvania, between Nov. 3, 2018, and Nov. 27, 2022.

According to the class action lawsuit, APi failed to pay workers for mandatory pre- and post-shift work in violation of the Pennsylvania Minimum Wage Act. In many cases, the plaintiffs say this unpaid work was considered overtime.

APi is an industrial and commercial specialty contractor with locations around the country.

APi hasn’t admitted any wrongdoing but agreed to a $1.05 million class action settlement to resolve these allegations.

Under the terms of the APi settlement, class members can receive a cash payment based on the number of hours they worked during the class period. According to the settlement website, class members can receive an estimated $33.73 for every 40 hours they worked.

Exact payment amounts will vary. Class members who received settlement notices may have received estimated settlement payment values with their notices.

The deadline for exclusion and objection is March 6, 2025.

The final approval hearing for the APi unpaid work settlement is scheduled for March 19, 2025.

To receive settlement benefits, class members must submit a valid claim form by March 6, 2025.
