couple counting settlement check moneyTop Class Actions viewers have reported receiving checks worth more than $1,800 from a Lidoderm antitrust class action settlement payout.

Most checks received by our readers were worth between $200 and $700, but one viewer reported receiving a massive settlement payout of $1,836.

These payouts are part of a $105 million class action settlement that was reached to resolve claims that several companies were part of an antitrust scheme that forced patients to pay more for their Lidoderm pain patches.

The settlement resolved claims against Endo Pharmaceuticals Inc., Teikoku Pharma USA Inc., Teikoku Seiyaku Co. Ltd., Actavis Inc., Watson Laboratories Inc., Actavis PLC, Anda Inc., Anda Pharmaceuticals Inc., and Valmed Pharmaceuticals.

Plaintiffs in the Lidoderm class action lawsuit claimed that Endo and Teikoku reached an unlawful antitrust agreement with the other defendants as part of a 2012 patent infringement settlement.

Endo and Teikoku allegedly agreed to pay the other companies so that they would delay the launch of their own generic Lidoderm patches. As a result, generic Lidoderm patches were reportedly not available until September 2013.

According to the Lidoderm antitrust class action lawsuit, consumers were forced to pay more for their Lidoderm patches as a result of the scheme.

“But for Defendants’ unlawful Agreement, at least one generic version of Lidoderm would have been marketed and sold in the United States as early as August 2012,” the Lidoderm antitrust class action lawsuit claims.

“And but for Defendants’ unlawful Agreement, Plaintiffs and the members of the Class would have been able to fulfill their lidocaine patch 5% needs at significantly lower prices far earlier than they did, instead of being forced to pay for branded and generic Lidoderm at higher prices.”

The defendants did not admit any wrongdoing by settling the Lidoderm class action against them, but agreed to pay $104.75 million in a combined settlement.

The settlement benefitted consumers who purchased branded or generic Lidoderm (lidocaine 5 percent) patch(es) between Aug. 23, 2012 and Aug. 1, 2014.

Third party purchasers were also eligible to recover compensation from the settlement if they provided payments or reimbursements for branded Lidoderm between Aug. 23, 2012 and Sept. 14, 2013 and/or generic Lidoderm between Sept. 15, 2013 and Aug. 1, 2014 in the following states: Arizona, California, Florida, Kansas, Maine, Massachusetts, Minnesota, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, South Dakota, Tennessee, West Virginia, or Wisconsin.

The deadline to file a claim with the Lidoderm class action settlement was Oct. 1, 2018.
