woman holding settlement cash moneyTop Class Actions viewers are starting to receive checks in the mail from the Subway FACTA class action settlement worth as much as $52.92.

Subway agreed to pay $30.9 million to settle a class action lawsuit that accused the company of violating the Fair and Accurate Credit Transactions Act by printing credit card expiration dates on its receipts.

Court documents indicate that the Subway settlement may be the largest FACTA settlement in history.

The Subway class action lawsuit was filed by Shane Flaum who alleged that Subway violated the federal law when it printed the entire expiration date of customers’ credit and debit cards on receipts.

FACTA requires retailers not to print more than the last five digits of a credit card or debit card number on a receipt, and may not print any part of the expiration date of the card. This law is reportedly to help prevent thieves from stealing others’ personal information to commit fraud or identity theft.

According to the Subway class action settlement, not all restaurant locations had printed too much credit/debit card information on a receipt. Reportedly, only some restaurants were equipped with a Subway Payment Manager system programmed to print credit or debit card expiration dates.

Class Members include those who purchased items from those affected Subway restaurants between Jan. 1, 2016 and March 23, 2017. 

Subway and Flaum agreed to settle the FACTA class action lawsuit to avoid the costs and risks of further litigation.

Flaum claimed that he and other consumers were injured by Subway’s conduct because they were at risk for identity theft and fraud. Allegedly, this could cause serious financial injury, and recovering from identity theft or fraud could cause consumers inconvenience and could take a long time.

The deadline to file a claim in the Subway credit card class action settlement was Jan. 22, 2019.
