Top Class Actions viewers are reportedly receiving settlement checks worth up to $17.20 from the Premier Protein shake class action settlement.

Lead plaintiffs alleged that the makers of Premier Protein, a line of protein-based powders and beverages, falsely advertised that their drinks contained 30 grams of protein.

However, according to a class action lawsuit, Premier Protein shakes contained two to five grams less than what was stated on the label.

The makers of Premier Protein, Premier Nutrition Corporation, agreed to pay $9 million to end the class action lawsuit in late 2018. Under the terms of the class action settlement, Class Members could claim up to $40.

Top Class Actions viewers have noted on our Facebook page that they have received settlement checks worth as much as $17.20 after submitting valid and timely claims in the Premier Protein share class action settlement.

Initially, the drink maker proposed offering coupons and cash payouts, but determined that the costs of notifying Class Members was excessive.

Instead Premier Nutrition set up a $9 million cash fund to resolve the Premier Protein class action settlement.

Class Members include those who purchased Premier Protein Ready-To-Drink Shakes between Aug. 8, 2011 through Oct. 12, 2018.

The Premier Protein shakes covered in the class action settlement include:

• Vanilla
• Chocolate
• Strawberries & Cream
• Banana & Cream
• Peaches & Cream
• Cookies & Cream
• Mixed Berry
• Organic Chocolate
• Organic Vanilla
• Caramel

According to the Premier Protein class action lawsuit, each individual drink is marketed and labeled as containing 30 grams of protein.

Additionally, the plaintiff alleged that Premier Nutrition had the capability of ensuring the proper amount of protein was included in each drink due to the protein sources used during manufacturing — Milk Protein Concentrate, Calcium Caseinate, and Whey Protein Concentrate.

The Premier Protein class action lawsuit states that protein is a highly sought-after ingredient in the minds of health-conscious consumers.

Fitness buffs look to add protein to their diet, claimed the plaintiff, and Premier Nutrition capitalized on this trend by advertising high amounts of the substance in their shakes.

According to the Premier Protein shake class action lawsuit, the plaintiff and other consumers would not have purchased the beverages had they known that they did not contain the 30 grams of protein advertised.

The deadline to file a claim for the Premier Protein Ready-To-Drink Shake class action settlement passed on Dec. 20, 2018.
