Top Class Actions viewers report that they are receiving checks worth as much as $45 from the Scotts Turf Builder EZ Seed class action settlement.

Class Members included California and New York consumers who purchased any variety of Scotts Turf Builder EZ seeds from 2009 through 2014.

Scotts agreed to pay customers $15 per package for up to six packages with proof of purchase.

Lead plaintiffs accused the Scotts Miracle-Gro Company of falsely advertising a defective grass seed mix.

According to the Scotts Turf Builder EZ Seed class action lawsuit, the company touted the mix as containing everything grass seeds need to grow “50% THICKER WITH HALF THE WATER.”

The seed mix, introduced in 2009, did not result in the promised results, alleged the plaintiffs.

The Scotts EZ Seed class action lawsuit claimed that the mulch, included in the mix, ended up absorbing most of the water, effectively competing with the grass seed.

“It doesn’t work,” alleged the Scotts class action lawsuit. “The super-absorbent mulch competes with the germinating seed for available moisture and actually prevents it from growing.”

The plaintiffs accused the company of producing advertisements on television, radio, and online that were “replete with false and misleading statements about the nature, characteristics and qualities of EZ Seed.”

In 2015, a federal judge certified proposed Classes of consumers who purchased the Scotts grass seed product in New York or California. By 2018, Scotts agreed to settle the class action lawsuit.

Under the terms of the settlement, Class Members with valid proof of purchase could receive up to $90 for six purchases of Scotts EZ seed.

Class Members without proof of purchase were eligible to receive $15 per package for up to three packages for a total of $45.

The deadline to file a claim for the Scotts EZ Seed class action settlement passed on Dec. 4, 2018.

Under the terms of the Scotts Turf Builder EZ Seed class action settlement, Class Members included those who purchased any variety of the EZ Seed product in New York or California between Jan. 1, 209 and Sept. 30, 2014 with labeling that promised 50 percent thicker growth than ordinary seeds.

Scotts admitted no liability under the terms of the class action settlement.
