Top Class Actions viewers are reporting that they have received settlement checks from the California Cipro class action settlement and the Ambit Energy class action settlement.
California Cipro Class Action Settlement
TCA viewers are receiving checks worth as much as $6,830 from the California Cipro class action lawsuit.
Lead plaintiffs in the California Cipro class action lawsuit alleged that Bayer, Barr Laboratories Inc., Hoechst Marion Roussel Inc., Watson Pharmaceuticals Inc., and The Rugby Group Inc. conspired to fix prices of the antibiotic by agreeing to help keep lower-cost generic versions of Cipro off the market.
The efficacy of Cipro was not questioned, but the drug makers were accused of inflating the price for consumers.
One of the defendants, Bayer, agreed to pay $74 million to settle the antitrust lawsuit in 2013. Hoechst Marion Roussel Inc., Watson Pharmaceuticals Inc., and The Rugby Group Inc followed suit in 2016 and paid $100 million to exit the litigation. Barr Laboratories agreed to settle the claims in 2017.
Class Members included those who purchased Cipro in California from Jan. 8, 1997 through Dec. 31, 2005.
The lead plaintiffs in the California Cipro class action lawsuit are represented by Eric B. Fastiff of Lieff Cabraser HeiMann & Bernstein LLP, Dan Drachler of Zwerling Schachter & Zwerling LLP, Joseph R. Saveri of Joseph R. Saveri Law Firm, and Ralph Kalfayan of Krause Kalfayan Slavens & Beink LLP.
The California Cipro Class Action Lawsuit is Cipro Cases I & II, J.C.C.P. Nos. 4154 and 4220, in the Superior Court of the State of California, County of San Diego.
Ambit Energy Class Action Settlement
Checks worth more than $2,000 have also been reported by TCA viewers who submitted claims in the New York Ambit Energy rate class action settlement.
Ambit Energy was accused of bilking New York consumers for energy costs in 2011 and 2012. The class action lawsuit alleged that the company took customers off of a cheaper plan by misrepresenting the savings off a new plan.
Plaintiffs say that they and other New York Ambit Energy customers were told in 2011 that they would see a one percent savings if they switched plans.
However, the company held the one percent savings under the new plan, and the class action lawsuit alleged that Ambit failed to disclose this fact to consumers.
The energy company compounded the problem by subsequently switching customers to a more expensive plan by default in 2012.
Ambit agreed to pay $26.5 million to settle the class action lawsuit.
Class Members included those who enrolled in Ambit Energy’s Guaranteed Savings Plan while in the State of New York between Sept. 5, 2010 and Feb. 22, 2018.
