A new Trojan condoms class action lawsuit alleges the Church & Dwight products are unfit for their intended purpose because they contain harmful โforever chemicals.โ
Plaintiff Matthew Goodman notes the Trojan condoms packaging touts the brand as โtriple testedโ and โtrusted for over 100 years.โ He claims Trojanโs brand recognition as a reputable brand of condoms allows Church & Dwight to charge a premium price over competing condom brands.
However, the lawsuit claims the products contain per- and polyfluoroalkyl substances (PFAS), a group of synthetic chemicals that persist and accumulate over time. Because of this persistent quality, PFAS are harmful at very low levels, the Trojan condoms class action lawsuit says.
Goodman says PFAS have been linked to a number of health problems, including thyroid disorders, immunotoxic effects, liver damage, decreased fertility and various types of cancer.ย
Church & Dwight โhad exclusive knowledgeโ about the content of Trojan condoms and whether they contained forever chemicals yet failed to inform consumers about Trojan condoms PFAS content, Goodman claims in the lawsuit.
Trojan condoms PFAS content not disclosed on label, plaintiff says
Goodman says he purchased Trojan condoms after carefully reviewing the productโs label. The package allegedly did not disclose the Trojan condoms PFAS content or any information about the potential harm associated with PFAS exposure.
โNo reasonable consumer would expect that a product marked for use on genetalia contain dangerous PFAS, which are indisputably linked to harmful health effects in humans,โ Goodman says in the lawsuit.
Had he been aware of the risk of Trojan condoms PFAS exposure, Goodman says he would not have purchased the products or would have paid significantly less for them.ย
The Trojan condoms class action lawsuit asserts claims for violations of New York general business law, breach of implied warranty, fraudulent concealment and unjust enrichment.
3M and other chemical companies were recently hit with a class action lawsuit alleging they sold repellents containing PFAS to carpet companies without disclosing the risk.
