Neighbors within a mile of a Colorado Nestlé Purina Petcare facility have filed a class action lawsuit claiming the facility emits noxious odors that are not properly controlled and mitigated by the company.
More than 2,000 households are located within a mile of the facility at 4555 York Street in Denver.
Purina uses animal-derived raw proteins and animal fat in the food, mixing the raw ingredients which are then dried and made into dough, the lawsuit says. The dough is then cooked and formed into a kibble shape before being dried, packaged and sold.
The cooking phase is what emits the odors, the lawsuit claims.
“A properly designed, operated and maintained pet food manufacturing facility will adequately capture, remove and dispose excess noxious emissions and will not emit noxious odors into the ambient air as fugitive emissions,” the lawsuit argues.
Facility exceeded noxious air limits during neighborhood visits from CDHE
Numerous complaints have been filed against Purina over the years for the facility’s odors, including with Colorado Department of Health and Environment (CDHE) for noxious emissions.
One CDHE report documented a visit to the facility, saying the facility’s plasma systems were supposedly operating normally but were overdue for maintenance.
“I drove to the neighborhood on the morning of 10/7 and observed a stronger than usual odor in the vicinity of 47th and Gaylord,” the CDHE report says. “The nasal ranger showed a state regulation exceedance of the 8:1 threshold. This was documented.”
A separate lawsuit against Nestlé Purina Petcare Co. claims it markets its pet food products as healthy even though the packaging allegedly contains harmful forever chemicals, a November 2023 lawsuit alleges.

It does be smelly when you wake up in the morning because of the Parina sometimes it makes you gag
I lived at 4545 Josephine for several years and the smell is overwhelming. I lost weight due to the obnoxious oders that it was hard to eat and sleep. This kind of facility should not be allowed to emit these fumes and or not be in a re4sidential area. I am sure it is doing us ore harm than we can even know.
